DMCA Notice & Takedown Policy

HorribleVideos.com ("the Site") respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond promptly to valid takedown notices and have adopted a repeat infringer policy.

2. Filing a DMCA Takedown Notice

If you believe that content on this Site infringes your copyright, you may submit a written takedown notice that includes all of the following:

  3. The exact URL(s) of the infringing material on our Site.

Incomplete notices may not be processed. Please ensure all six elements above are included.

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may file a counter-notification containing:

  1. Your full legal name, address, phone number, and email.
  2. Identification of the material removed and the URL where it appeared.
  3. A statement under penalty of perjury that you believe the material was removed as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district in which the Site operator may be found) and that you will accept service of process from the person who filed the original takedown notice.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

4. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, users or accounts that are repeat infringers of copyright.

5. Good Faith

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be liable for damages, including costs and attorneys’ fees.
